UPDATE: Dauphin County Court responds to request for O&N criminal complaint documents
We’ve recently written about a criminal complaint filed by the Pennsylvania Office of the Attorney General against engineering firm O’Donnell & Naccarato (O&N). The Philadelphia Archdiocese commissioned O&N to produce a report, which assesses the condition of St. Laurentius Church.
In their 1994 complaint, the Attorney General alleged that O&N didn’t properly report cash donations they made to the Bucks County Republican Party. Bucks County subsequently awarded O&N several hundred thousands of dollars in construction contracts, according to The Philadelphia Inquirer.
We requested copies of the documentation included with that case from the Dauphin County Court of Common Pleas. In a response letter, the court clerk explains that the
“office does not have or is unable accommodate your request… No such records [were] located. The [Inquirer] article reads that the case will be ‘expunged’ upon successful completion. Therefore, if the case was expunged it would have been destroyed.”
Here, the clerk refers to an agreement O&N and the presiding judge reached. The court offered to expunge the case from record on two conditions: that the firm serve a one-year probationary period and that it donate $500 to charity.
